Terms of Use

These Terms of Use ("Terms") govern your use of the Wakey mobile application ("App", "we", "us"). By downloading or using the App, you agree to these Terms.

1. Description of Service

Wakey is an alarm clock application that uses puzzles and gamification to help users wake up more effectively. The App offers both free and premium features.

2. Subscriptions and Purchases

2.1 Subscription Plans

Wakey offers the following subscription plans:

  • Wakey Pro Monthly — Monthly subscription with full access to all features
  • Wakey Pro Yearly — Annual subscription with full access to all features at a discounted rate
  • Wakey Pro Lifetime — One-time purchase for permanent access to all features
  • Ad-Free — Monthly or annual subscription to remove advertisements

2.2 Free Trial

Some subscription plans include a free trial period (e.g., 7 days). You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically renew and you will be charged.

2.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the current period ends. You can manage and cancel your subscriptions in your iOS Settings under Subscriptions.

2.4 In-App Purchases

The App offers additional in-app purchases:

  • Snooze Pass — Allows you to snooze the alarm once
  • Emergency Stop — Allows you to immediately stop the alarm

These are consumable purchases and are used upon activation.

2.5 Refunds

All purchases are processed through Apple's App Store. Refund requests must be submitted to Apple directly through their support channels.

3. Hard Mode and Penalties

3.1 How Hard Mode Works

Hard Mode is an optional feature that adds real financial consequences to alarm dismissal. When enabled:

  • Snooze is disabled
  • If you forcefully close the app or dismiss the alarm without solving all puzzles, a penalty fee is charged
  • The penalty amount is displayed before you enable Hard Mode

3.2 Payment Method

Hard Mode requires you to register a payment method (credit card or Apple Pay) through Stripe. Penalties are charged automatically when a violation is detected.

3.3 Consent

By enabling Hard Mode and registering a payment method, you explicitly consent to automatic penalty charges. You can disable Hard Mode at any time in the App settings (changes take effect for the next alarm).

4. User Conduct

You agree not to:

  • Reverse engineer, decompile, or disassemble the App
  • Attempt to bypass the alarm puzzles through technical means
  • Use the App for any unlawful purpose
  • Share your account or in-app purchases with others

5. Intellectual Property

All content in the App, including but not limited to text, graphics, logos, sounds, and software, is the property of Wakey and is protected by copyright and other intellectual property laws.

6. Disclaimer of Warranty

The App is provided "as is" without warranty of any kind. We do not guarantee that the alarm will function perfectly in all circumstances. We are not responsible for any damages resulting from missed alarms, including but not limited to being late for work or appointments.

7. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.

8. Right of Withdrawal (EU)

If you are located in the European Union, you have a 14-day right of withdrawal for digital purchases. However, by making a purchase through the App Store, you consent to immediate delivery and acknowledge that you waive your right of withdrawal once the digital content has been delivered.

9. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. For consumers in the EU, mandatory consumer protection laws of your country of residence apply in addition.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. Significant changes will be communicated through the App. Continued use of the App after changes constitutes acceptance of the new Terms.
